Choose A Conveyancer Carefully!

There are many risks involved when transferring property both from a Seller & Buyer point of view. For example, if you are Selling, you want to ensure all monies due to you from the Buyer are adjusted at settlement and that your sale proceeds are provided to you on settlement in the manner you require. If you are Buying, it is important to know that you will be properly protected and the property will be transferred legally into your name before all of the monies are handed over to the Seller and that you understand exactly what you have purchased including all encumbrances on the land.

New Stamp Duty Ruling

The Office of State Revenue (“OSR”) has recently issued a new Revenue Ruling in relation to the use of “nominee” clauses. Revenue Ruling SD36.0 replaces Commissioner’s Practice SD1.3 with effect from 1 October 2007.

Be Aware of Changes to the Franchising Code of Con

Many people in the franchising sector are not aware of recent proposed changes to the Franchising Code of Conduct (“Code”). In 2006 the Matthews Report was produced, which examined franchising in Australia. Some of the recommendations made in the report have been incorporated as amendments to the Code. These amendments are expected to take effect from 1 March 2008.
